Establishing a will is important for many reasons:

  • It provides clear instructions for the distribution of your property upon your death.
  • It allows you to formally name a guardian for your minor children.
  • It may potentially lower or eliminate your estate tax burden.
  • When you establish a will, it will be necessary for you to name the executor the person responsible for carrying through with the will’s instructions. The executor can be a relative, friend, or a trusted advisor.

    You may wish to establish a living will or health care proxy in conjunction with your will. A living will is a legal document setting forth your wishes regarding future health care, specifically, the withholding or withdrawal of life sustaining medical treatment that may prolong your death. A health care proxy sets forth your wishes regarding medical treatment if, in the future, you are incapacitated and unable to make informed medical decisions.

    You may also wish to establish a trust in which to distribute assets.
